Proper care ensures the longevity and beauty of your wood furniture. Follow these expert tips to maintain, clean, and restore your pieces effortlessly.
Water rings can dull your furniture’s finish, but they’re easy to treat using common household methods. Choose one of the approaches below based on what you have available.
Baking Soda Method -
Step 1: Mix 1 tablespoon of baking soda with 1 teaspoon of water to create a paste.
Step 2: Using a soft cloth, gently rub the paste into the water ring.
Step 3: Wipe clean and allow the surface to air dry.
Petroleum Jelly Method -
Step 1: Apply a thin layer of petroleum jelly to the water ring.
Step 2: Let it sit overnight.
Step 3: In the morning, wipe away the jelly with a clean cloth.
Toothpaste Method -
Step 1: Apply a non-gel toothpaste directly to the stain using a soft cloth.
Step 2: Gently rub in the direction of the wood grain.
Step 3: Wipe clean with a damp cloth and allow the surface to air dry.
For deeper stains: Mix the toothpaste with baking soda before rubbing it in. Continue working along the grain for best results.
Watch this video guide for step-by-step instructions on tackling heat marks on wood furniture.
Quick Fix Using Household Items: To remove white heat stains from wood surfaces, you only need four common household items: a steam iron, a clean towel, a paper towel, and a bit of vegetable oil. This method takes just 30 to 60 seconds and can effectively eliminate most white heat stains caused by hot items like mugs or dishes.
Steps to Remove Heat Marks -
Step 1: Cover the stain with a towel and gently run a steam iron over it for a few seconds to allow heat and steam to lift the mark.
Step 2: If the stain begins to reappear, apply a small amount of vegetable oil to a paper towel.
Step 3: Quickly iron over the towel again, then rub the oil into the wood in circular motions to seal and restore the finish.
Why it works: The combination of moist heat and oil helps rehydrate the wood finish and remove cloudy white marks without damaging the surface.
Note: Before applying any cleaning solution to the entire wood surface or affected area, test it on a hidden spot—such as the underside of a table leg—to ensure it doesn’t damage the finish. If the finish remains unaffected, proceed with the steps below.
Steps to Remove Smudges -
Step 1: Mix a few drops of mild dish soap into a bowl of warm water.
Step 2: Dampen a soft cloth or sponge with the soapy solution (do not soak the wood).
Step 3: Gently wipe the smudged surface.
Step 4: Dry the area thoroughly with a clean cloth a few minutes after cleaning.
Are you struggling with stubborn fingerprints? Just follow these steps below for a flawless finish.
Steps to Remove Fingerprints -
Step 1: Mix 1 cup of mineral oil with a few drops of lemon extract, or use a commercial wood polish.
Step 2: Apply the polish with a soft cloth, wiping gently along the wood grain. Avoid circular motions to prevent streaks.
Step 3: Lightly sprinkle cornstarch over the polished surface.
Step 4: Buff with a clean, dry cloth to remove excess polish and restore shine.

Caring for your furniture shouldn't be complicated. We've made it easy with fabric-specific guides designed to keep your pieces looking their best. From rich velvet to modern bouclé, each fabric deserves its own care. Find easy, fabric-specific tips and tricks to help your favorite pieces stay beautiful and last longer.
Velvet is a luxurious and delicate fabric. With the right care, its signature softness and elegant texture can last for years. This guide helps you treat wrinkles, stains, and general wear—without damaging the pile.
Removing Creases & Flattened Pile in Velvet
Before You Start -
Steps to Remove Wrinkles -
Step 1: Use a handheld steamer (preferred) or the “Steam” function on an iron set to the lowest heat (~300°F).
Step 2: Begin steaming from a distance and slowly move closer—but never closer than 1 inch.
Step 3: Let the steam rise onto the fabric. Do not press the steamer or iron directly onto the velvet.
Step 4: Steam from bottom to top to maximize lift.
Step 5: Gently brush the fabric in the same direction as its natural texture using a soft-bristle brush, microfiber towel, or terry cloth.
Cleaning Stains & Spills on Velvet
Velvet is absorbent, so acting quickly can make a big difference when dealing with spills or stains. Follow these steps for safe, effective cleaning without damaging the texture.
Steps to Clean Spills -
Step 1: Blot the affected area immediately using a clean white cloth or paper towel — do not rub, as this can flatten the fabric.
Step 2: Slightly moisten the cloth with lukewarm water if needed and continue blotting gently.
Step 3: For light stains, mix a few drops of dish soap with warm water and whip into suds. Apply only the suds with a soft cloth, dabbing gently.
Step 4: For tougher stains, apply a dry-cleaning solvent (such as Guardsman Fabric Cleaner or Blue Coral Dri-Clean) to a cloth and dab lightly — never directly on the fabric.
Step 5: Let the area air dry fully. You may use a hairdryer on the lowest setting if necessary.
Recommended Products: Scotchgard™ Fabric & Upholstery Protector is safe for velvet when used as directed. Hold the can 6" from the fabric and apply an even coating once per year for best results.
Natural textures like sheepskin, shearling, and fur add warmth and softness to your space—but they require a little extra care to stay beautiful and fluffy. Use these tips to prevent matting, remove stains, and keep the fibers fresh.
General Maintenance
Sheepskin, shearling, and fur are naturally luxurious, but they need gentle upkeep to stay soft, fluffy, and long-lasting.
Regular Care -
Air It Out: Regularly expose the piece to fresh air—this helps reduce odors and restore softness. Avoid direct sunlight.

Cushions are the heart of comfort and appearance in any seating. Keep them clean, well-shaped, and long-lasting with the right care routine.
Steps to Clean Cushions -
Step 1: Remove cushions (if detachable) to access seams and clean surrounding surfaces.
Step 2: Use a vacuum with a soft-bristle or upholstery attachment to remove dust, debris, and pet hair.

Fluffing & Reshaping Cushions
Over time, cushions can lose their shape or appear sunken. Regular plumping helps restore their structure and comfort.
Steps to Plump Cushions -
Step 1: Remove throws or decorative pillows.
Step 2: If your cushions are removable, rotate and flip them weekly to distribute wear.
Step 3: Plump each cushion by hand—grab the edges and push the filling toward the center.

Step 5: Finish by gently patting the sides of scatter cushions and decorative pillows using a soft patting motion to bring air back into the filling and restore fullness.
Whether you're caring for glossy lacquer, porous marble, raw concrete, or composite surfaces like FRP, each material requires its own tailored approach. This guide helps you understand how to clean, maintain, and restore specialty finishes so they remain durable, safe, and beautiful over time.
Steps to Repair Scratches on Gloss Lacquer -
Step 1: Get the TOV Replacement Paint Kit from our official product care page.
Step 2: Lightly sand the scratch using minimum 1000-grit sandpaper. Sand only the affected area.
Step 3: Apply thin, even layers of paint. Let each layer dry before adding another.
Step 4: Speed up drying using a blow dryer on cool setting.
Step 5: Buff gently with a soft rag to finish.
Marble is a beautiful but porous material, meaning it easily absorbs liquids and is vulnerable to stains and etching (surface dulling) caused by acids like lemon juice or vinegar. Proper sealing and cleaning help preserve its elegance and protect it from permanent damage.
Sealing Marble to Prevent Stains
You’ll Need -
Steps to Seal Marble -
Step 1: Thoroughly clean the surface using a natural stone cleaner and let it dry completely.
Step 2: Test the sealer on a small, hidden section of marble and wait 24 hours to ensure it doesn't cause discoloration or film buildup.
Step 3: Using a soft microfiber towel, apply the sealer in thin, even layers across the surface.
Step 4: Let the sealer sit for the dwell time recommended on the product label.
Step 5: Wipe away any excess before it dries to avoid a sticky residue.
Step 6: For more porous marble, apply a second coat after 15–30 minutes, following the same steps.
Step 7: Allow the surface to cure fully before use (usually 24 hours).
How to Check If Marble Needs Resealing
Use one of these simple at-home tests to know when it's time to reseal your marble surface.
Water Drop Test -
Step 1: Sprinkle a few drops of water on the marble.
Step 2: Wait 4 minutes.
Step 3: If the water is absorbed and darkens the stone, resealing is recommended.
Mineral Oil Test -
Step 1: Place a few drops of mineral oil on the marble.
Step 2: Wait 10 minutes, then wipe it off.
Step 3: If the spot darkens, the surface has absorbed the oil—time to reseal.
Removing Stains from Marble
Even sealed marble can stain if liquids sit too long. Here's how to treat the most common types of marble stains with care—using the right method for each.
Note: Always test any cleaning method on a hidden area to ensure it doesn’t damage the finish before applying it across the entire surface.
Water Spots & Rings: Usually caused by hard water deposits or moisture left on the surface.
To Remove -
Oil-Based Stains (Grease, Cosmetics, Cooking Oil): These stains darken the stone and may appear slightly translucent.
To Remove -
Organic Stains (Coffee, Tea, Fruit, Food, Tobacco): These leave brown, yellow, or pink discoloration over time.
To Remove -
Step 1: Mix a solution of 12% hydrogen peroxide and a few drops of ammonia.
Step 2: Apply with a soft cloth and blot (don’t rub) the area.
Step 3: Let it sit for a few minutes, then wipe away with a damp microfiber towel.
Step 4: Rinse and dry the surface completely.
Ink Stains: Different approaches work depending on marble color.
Light-colored marble -
Dark-colored marble -
Metal Stains (Rust, Copper, Bronze): Appear as orange, green, or brownish discoloration caused by metal objects sitting on wet stone.
To Remove:
Concrete has a beautiful raw texture but can be prone to surface imperfections like minor scrapes or chips. TOV offers a simple solution to refresh and restore these areas.

Step 2: Gently sand the damaged area with fine-grit sandpaper to smooth rough edges.
Step 3: Apply the TOV Concrete Repair Kit as per the instructions included in the box.
Step 4: Allow the repair product to dry fully before placing anything on the surface.
Recommended Resources:
Fiberglass Reinforced Plastic (FRP) is durable, water-resistant, and commonly used for structural furniture components or bathroom furniture. However, black stains—often caused by mildew or grime buildup—can dull its appearance over time.
Note: Always test any cleaning method on a hidden area to ensure it doesn’t damage the finish before applying it across the entire surface.
Steps to Remove Black Stains from FRP -
Step 1: Start by rinsing the area with warm water to remove loose surface debris.
Step 2: Use a non-abrasive FRP-safe cleaner and a soft sponge or microfiber cloth to gently scrub the surface.
Step 3: Rinse again with clean water and dry the area thoroughly to prevent moisture buildup.
Recommended Product: Bio-Clean Hard Water Stain Remover (safe for FRP) – highly rated, non-toxic, and safe for use on fiberglass surfaces.

Wicker is a general term used for any type of woven furniture. It's often crafted from natural materials such as reed, cane, rattan, seagrass, bamboo, and willow, but synthetic options like resin and vinyl are also used. So, if you own “wicker” furniture, you’ll need to figure out what it’s made of to care for it correctly.
Rattan
How it looks: Rounded, vine-like structure with smooth surface.
Usually found in: Frames, armrests, curved edges.
Cane
How it looks: Shiny, flat weave in a crisscross pattern.
Usually found in: Chair seatbacks, drawer panels, chair bottoms.
Bamboo
How it looks: Hollow and smooth with visible joints or “rings”.
Usually found in: Furniture legs, frames, support structures.

Whether you’re setting up a new piece or fine-tuning an existing one, these guides help troubleshoot common concerns like uneven legs, stuck drawers, or missing hardware. Easy-to-follow instructions make sure your TOV furniture fits and functions as intended.
Wobbling furniture is often caused by assembly misalignment or uneven floors. Fortunately, a few quick checks and adjustments can help stabilize the piece.
Steps to Fix Uneven Legs or Wobbling -
Step 1: Double-check the leg labels—legs marked “B” may include sub-labels like B1, B2, etc. Make sure each leg is installed in the correct position based on the underside label or instruction guide.
Step 2: Loosen all bolts halfway before making any adjustments. This allows the frame to settle naturally when upright.
Step 3: Place the furniture upright on a flat surface (a floor or table). Gently press down on each corner to help the legs level out.
Step 4: Once leveled, tighten each bolt fully, alternating between opposite corners for balance.
Step 5: Look underneath the legs and check for adjustable glides or foot levelers -
• If present, rotate to raise or lower the leg for fine-tuning.
• If your legs do not have adjustable tips, place a felt pad or wedge under the shorter leg to help balance it.
Uneven cabinet doors can shift during transit or assembly. TOV’s concealed European-style hinges offer built-in adjustability, allowing you to fine-tune spacing and alignment without removing the doors.

A stable sleep setup starts with secure bed slats. If your slats shift or feel unstable, these steps will help you reinforce them using TOV’s Easy KD Roll-Out Slat System.
How the System Works: TOV beds use a roll-out system where slats are pre-connected via nylon straps and secured by friction, weight, and—if needed—light hardware.
Steps to Stabilize Bed Slats -
Step 1: Ensure the slats are laid out evenly across the bed frame - Make sure the nylon strap is flat and not twisted between slats.
Step 2: Double-check that each slat’s end peg fits securely into the corresponding hole or groove in the bed frame - Press down gently to seat the slats properly.
Step 3: Add the mattress to weigh the system down - The mattress weight will help keep the slats in place through friction.
Step 4: For extra stability, use small wood screws to secure the outermost slats.
Note: Drill pilot holes before screwing into the bed frame to avoid wood splitting.

Steps to Remove Undermount Drawer Glides -
Step 1: Open the drawer fully.
Step 2: Look under the drawer near the back—you’ll see two plastic tabs or clips on either side.
Step 3: Push both tabs inward at the same time while pulling the drawer outward to release.
Step 4: To reinstall, align the metal glide rails with the drawer’s underside grooves and push in until it clicks.

General Information
We stand behind the quality of products we sell. While cases are rare, damages and defects do happen once in a while.
If an item is damaged or defective but repairable, TOV Furniture reserves the right to arrange for a specialized furniture repair technician to visit the customer’s home for repairs. The technician will address only the damage specified in the claim. If the customer requests repairs for issues not reported in the claim, TOV will not cover those costs. Replacements or credits will only be issued if the item is deemed irreparable. If the item is deemed repairable and the customer refuses this resolution, this would be considered buyers remorse.
We stock a comprehensive range of spare parts, including legs, hardware packs, and more. For minor damage or when only a replacement part is needed, we will provide the specific part rather than a full replacement.
For minor issues, we may offer a small "Keep As Is" discount to the customer. However, this discount will not be combined with other resolutions. If a full replacement or other corrective measures are provided, the "Keep As Is" discount will not apply. Each resolution option will be handled independently to ensure the customer’s concerns are effectively addressed. By accepting a Keep As Is solution, it will void our standard warranty.
If a replacement is deemed necessary for a manufacturer defect or a transit related issue, TOV Furniture will provide it at no cost. If the replacement costs are deemed excessive, we reserve the right to cancel the order and issue a refund.
If a full replacement or refund is provided for a damaged or defective item, TOV Furniture reserves the right to request that the original item be donated. Proof of donation must be submitted before the refund or replacement is processed.
Orders can be canceled or modified at no additional cost prior to shipment from our warehouse by emailing us. Please be aware that even if an order is not marked as shipped, it may already be in transit and therefore cannot be canceled. We aim to process and ship orders promptly after they are placed, which often leaves only a brief window for changes. As a result, we cannot guarantee that all requests for order changes or cancellations will be accommodated. If your order has already shipped, you are not eligible for a free cancellation.
If an order is currently in transit but has not been delivered yet, and the customer requests a cancellation, it would be considered a buyers remorse returns and it will be the customer's responsibility to cover the return fees + a restocking fee.

As a result, we cannot guarantee that all requests for order changes or cancellations will be accommodated. If your order has already shipped, you are not eligible for a free cancellation. If an order is currently in transit but has not been delivered yet, and the customer requests a cancellation, it will be the customer's responsibility to cover the return fees.
If your purchase isn’t quite right, you may initiate a return within 15 days of delivery for store credit. Returns are accepted for all categories except pillows, throws, rugs, cups, placemats and mattresses.
All returns are subject to:
If a delivery is refused because the items do not fit, it will be considered a buyer’s remorse return and subject to the same return fees.
We are unable to accommodate returns / exchanges / refunds for any Clearance or Final Sale Items.
Products must be in new or unused condition (for example no stains, tears, or other soiling including odors). Products with scratches, stains, damages, drilling, or other modifications cannot be returned. Products must be returned in the original packaging with all original product inserts. Last Chance, Final Sale and Clearance item sales are final, and returns cannot be issued. Any return shipping and/or delivery fees are non-refundable. Proof of purchase is required for all returns and refunds.
The returned merchandise will be inspected within 72 hours of arriving at our warehouse. Once we’ve determined that the product is in as-new condition, our team will process your return and issue a refund minus the return shipping fees.
Please note that depending on your card issuer’s policy, it may take up to 10 business days for your refund to appear on your credit statement.
Store Credit May Not Be Issued If:

TOV Furniture deliveries to commercial and residential locations within the continental U.S. (48 states). We do not ship to Alaska, Hawaii, or Puerto Rico. Areas that are inaccessible with our standard home delivery trucks, are considered remote areas, or locations which require alternative delivery methods will require extra fees. However, in those instances, said fees will be reviewed with you prior to delivery. If you are aware of restrictions for delivery, be sure to convey prior upon placing the order so we can proactively make arrangements with most cost effective options.
TOV Furniture ships all orders using one of the following two methods:
LTL (Less-than-Truckload) Delivery
For larger items, our furniture delivery specialists will schedule a delivery appointment with you or your customer in advance. On the scheduled date, the delivery team will bring the items to the first dry spot or "threshold" of your home, requiring a signature upon receipt. If you live in building, the carrier may be able to bring the product upstairs to your door if there are no steps involved and the elevator is large enough but this is not guaranteed or part of our normal delivery procedure.
If we cannot contact the recipient within 15 calendar days to arrange delivery, and there is no communication from you or the delivery agent, TOV Furniture reserves the right to consider the order canceled as a buyer's remorse and return shipping fees will apply. Storage fees will apply if the recipient cannot accept delivery within a reasonable timeframe.
Ground and Doorstep Delivery
This option generally applies to smaller items shipped via parcel carriers. The order will be delivered to your doorstep or the entrance of your building, and a signature is not required. The recipient is responsible for bringing the items into the home and performing any necessary assembly. Delivery appointments are not scheduled in advance, but can be monitored in the provided tracking information to check the expected delivery date or contact the carrier directly for updates.
Deliveries that involve navigating through tight spaces or carrying items beyond two flights of stairs will incur additional fees. If the delivery location is deemed difficult or unsafe—whether for White Glove (WG) or standard delivery services—TOV Furniture and/or the carrier reserves the right to refuse delivery. This includes areas such as narrow or curved landings that may endanger the safety of the delivery team or your property. If delivery cannot be completed, applicable charges may still apply.
Upgrades to White Glove delivery, which includes in-home setup, are available for an additional fee. In the event that damage occurs during White Glove service, it must be noted on the Bill of Lading (BOL) at the time of delivery to qualify for reimbursement. White Glove deliveries include two personnel. If a third person is required due to the delivery location, additional fees will apply. Additional charges may also apply if there is no elevator and a certain number of stairs are involved.
In-stock items are typically delivered within 1-4 weeks from the date the order is placed. We will provide ongoing updates as your order progresses. Please note that delivery timeframes are estimates, and actual delivery may occur earlier or later due to the nature of nationwide furniture deliveries and unforeseen events. TOV Furniture cannot offer compensation for deliveries that do not occur exactly as scheduled.
Our standard delivery service does not include disassembly. If disassembly is needed, the customer is responsible for managing it.
If an item does not fit in your home and cannot be accepted, it will be considered a buyers remorse return. For multiple delivery attempts, the customer is responsible for all additional delivery costs beyond the first attempt. If we are unable to reach you to arrange delivery within 15 calendar days, TOV Furniture reserves the right to treat the order as a return. Refunds will be processed using the most recent address and payment information provided.
If the delivery location requires a Certificate of Insurance (COI), it is your responsibility to provide this information in advance to ensure we have adequate time to process it. Failure to provide the COI before the order ships from our facility may result in additional fees.
TOV Furniture is not responsible for any damage to your home or property during the delivery or installation of furniture, regardless of the delivery method. Any claims regarding property damage must be directed to the carrier responsible for the delivery. We strongly recommend inspecting your property and items upon delivery and promptly reporting any issues to the carrier.
To ensure a smooth delivery, please adhere to the following procedures and communicate these details to the recipient:
We do not allow customer pickups at this time.
We do not offer international shipping. However, we can deliver your order to a freight forwarder of your choice. It is the customer's responsibility however to arrange the freight forwarding service and cover any associated overseas shipping costs directly with the forwarding company.
TOV Furniture is not responsible for lost or stolen goods once a package has been marked as "delivered" by the carrier. We recommend ensuring that your shipping address is secure and using tracking services to monitor your package. If your package is lost or stolen, it is your responsibility to handle it directly with the carrier or your building. By placing an order, you agree to this policy.
With proper care, TOV Furniture is designed to be enjoyed for years to come. For normal residential use, we offer a one-year warranty from the date of delivery, covering defects in materials and workmanship. Please note that we are not liable for any incidental or consequential damages. Read more details about what our warranty covers here.
At TOV Furniture, we are committed to ensuring that all orders arrive in perfect condition. In the event of transit damage or manufacturer defects, customers must allow TOV Furniture or our shipping agent to resolve the issue at no cost. Our goal is always to ensure customer satisfaction. However, if you choose to refuse this resolution option, the order will be canceled, and our buyers remorse will apply. Additionally, if a proposed solution is not acknowledged within 15 days, the case will be considered closed, and the proposed solution will no longer be valid. This policy remains the same for Final Sale Items.
In the rare event of transit damage, a claim must be submitted via our claims form within 72 hours of delivery to the original shipping address. Concealed damage must be reported to both us and the shipper within 24 hours of arrival. All shipments are insured against damage. Upon delivery, verify that the paperwork is accurate and that the correct items and cartons have been received. Inspect both the packaging and the contents for any shipping damage. Any damage must be noted on the delivery receipt to claim insurance. For partial damage or shortages, accept the good items and list any damages or shortages on the delivery receipt. If damage is noted, we will send the necessary parts or provide a solution at no cost, which may include repair by a professional, part replacements, or a full unit replacement.
For LTL Shipments: Report any damage or improper assembly at the time of delivery and note it on the Bill of Lading. Failure to do so means TOV Furniture will not be responsible for remedy, restoration, or replacement. Inspect your entire order thoroughly, including all sides, moving parts, and assembly provided by our delivery partner.
If WG upgrades are involved, our delivery partner will handle assembly. Any issues with assembly must be addressed at the time of delivery. As the customer, you are responsible for ensuring proper assembly and for any issues arising from improper assembly. TF does not warrant or guarantee assembly and is not liable for damage to goods, personal property, or individuals due to improper assembly.
For Small Parcel Delivery (FedEx or UPS): Retain all packaging and report damage to TF immediately. We will require photos of the packaging and the damaged item. Concealed damage must be reported to us and the shipper within 24 hours of arrival.
Quality is of utmost importance to us, and our quality control team carefully inspects each item to ensure it meets our standards. In the rare event of a manufacturer defect, you must complete and submit a claims form along with all necessary documentation. This includes, but is not limited to, clear photos of the defect and any relevant areas of the item, the PO number or batch number stamped on the bottom of the piece (also available on the carton), which helps us identify the batch and specific details related to your order, and any other details or documents requested by our agent.
Failure to provide the required documentation may delay the resolution process. We will review the information provided and work to offer a suitable solution in accordance with our terms.
Right to Repair
If an item is damaged or defective but repairable, TOV Furniture reserves the right to arrange for a specialized furniture repair technician to visit the customer’s home for repairs. The technician will address only the damage specified in the claim. If the customer requests repairs for issues not reported in the claim, TOV will not cover those costs. Replacements or credits will only be issued if the item is deemed irreparable.
Spare Parts
We stock a comprehensive range of spare parts, including legs, hardware packs, and more. For minor damage or when only a replacement part is needed, we will provide the specific part rather than a full replacement.
Keep as is Discount
For minor issues, we may offer a small "Keep As Is" discount to the customer. However, this discount will not be combined with other resolutions. If a full replacement or other corrective measures are provided, the "Keep As Is" discount will not apply. Each resolution option will be handled independently to ensure the customer’s concerns are effectively addressed. By accepting a Keep As Is solution, it will void our standard warranty.
Replacements
If a replacement is deemed necessary for a manufacturer defect or a transit related issue, TOV Furniture will provide it at no cost. If the replacement costs are deemed excessive, we reserve the right to cancel the order and issue a refund.
Donations
If a full replacement or refund is provided for a damaged or defective item, TOV Furniture reserves the right to request that the original item be donated. Proof of donation must be submitted before the refund or replacement is processed.

Any dispute or claim relating in any way to your use of any TF products or services sold or distributed through tovfurniture.com will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to this agreement. We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration we each waive any right to a jury trial. We also both agree that you or we may bring suit in court to enjoin infringement or other misuses of intellectual property rights.
As to any claim made against TF, you agree that your damages, if any, shall, to the fullest extent permitted by law, be limited to the amount of money you paid to TF for the cost of goods as well as any shipping costs you paid directly to TF (but not to any third party). We do not guarantee that we will be able to fill every order and you should not expect that simply because an order is placed or an item is listed in our catalog or website, that such item is definitely available. If you place an order which we are unable to complete, then, if you have made a payment to TF , you agree that your damages shall be limited to a refund of the amount you paid. If you did not pay for the order, you shall not be entitled to damages or to recover anything from TF for being unable to complete an order. You agree that, in all instances, you are not entitled to, and TF shall not be liable for, incidental, punitive, exemplary, indirect or consequential damages (including but not limited to lost profits, loss of use, damage to third parties, or any diminution of value) arising under or relating to any items you purchase, order, obtain, or seek to obtain from TF .
If you resort to disputing or reversing a charge or submitting a dispute claim with your financial institution in an attempt to reverse or withhold payment from TOV Furniture for either a portion or the entire sum of your order, you are thereby forfeiting your rights to any promotional offers that were provided with your order. These are including but not limited to reward points and free accidental damage protection plans.
You and TOV Furniture agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. Further, unless both you and TOV agree otherwise, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding.
Enforceability. If the Section entitled “No Class Actions” is found to be unenforceable, then the entirety of this Section will be null and void and, in that case, the parties agree that the exclusive jurisdiction and venue described directly below will govern any action arising out of or related to these Terms or your use of the Site or Products.
Choice of Law; Venue. These Terms will be governed and construed in accordance with the laws of the State of New York, excluding its conflicts of law rules. If a lawsuit or court proceeding is permitted under these Terms, then you and TOV agree to submit to the personal and exclusive jurisdiction and venue of the state and federal courts located within New York, New York.
TOV Furniture reserves the right to make changes to our site, policies, Service Terms, and these Terms and Conditions at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
